The Secretary of State may
investigate and pursue compliance in the areas listed below. Violations
which may be investigated, reviewed for
administrative action where the law allows, or referred to a prosecutor include:
Elections: Illegal
voter registration, voting, voter assistance, influence of voters and vote
buying; illegal contributions, expenditures, payment of election workers, and
other illegal campaign finance activity; violations by election officials,
such as tampering with ballots or voting systems, altering returns, destroying
ballots; and other violations.
Private Investigator
Licensing: Operating without a
license, employing unqualified persons to conduct investigation business,
disclosing information relating to an investigation.
Security Guard Licensing: Operating
without a license, employing unqualified persons to conduct security guard
business.
Charitable Organizations
Registration: Soliciting in WV
without registration, failure to disclose financial information as required,
obtaining money with intent to defraud, use of funds for purposes other than
identified in organization documents.
Professional Fundraiser
Registration: Soliciting in WV
without registration, failure to disclose
financial information as required, obtaining money with intent to defraud.
Notary Public: Performing
an improper notarization, including notarizing without in-person
acknowledgment of the signer or executing an oath not signed in the presence
of the notary; performing a notarial act when a disqualifying interest exists;
performing a notarial act with intent to defraud.
Corporations: Operating
without registration as a corporation; operating under a trade name without
registration. NOTE: The State
Tax Department Compliance Division has staff to investigate companies
doing business without a business franchise certificate.
